We understand how difficult it is to deal with the loss of a loved one. The last thing on your mind is having to go through a lengthy probate proceeding. There are two types of probate administration under Florida law: formal administration and summary administration.

Formal Administration requires the appointment of a Personal Representative, or executor, to administer the decedent’s estate. The Personal Representative will work closely with the attorney and assist in gathering various documents, he or she will notify creditors, pay final bills, taxes, distribute assets, among other duties. Formal Administration can take anywhere between 6 to 9 months under most favorable circumstances, but can last years if it involves unforeseen events, such as missing heirs, or if it involves litigation.

Florida also offers a simplified probate process, called Summary Administration, which can be very efficient in settling small estates if the value of the estate does not exceed $75,000 or the decedent had passed more than 2 years ago. Fla. Stat. §735.201 (2). Summary Administration does not require the appointment of a Personal Representative.

Summary Administration can be less expensive and time-consuming than Formal Probate.
